{"id":7559,"date":"2018-01-08T12:07:55","date_gmt":"2018-01-08T10:07:55","guid":{"rendered":"https:\/\/www.rm-assessors.cat\/hipoteca-multidivisa-es-pot-considerar-abusiva-i-reclamar-les-quantitats-pagades-en-exces\/"},"modified":"2018-01-08T12:07:55","modified_gmt":"2018-01-08T10:07:55","slug":"hipoteca-multidivisa-es-pot-considerar-abusiva-i-reclamar-les-quantitats-pagades-en-exces","status":"publish","type":"post","link":"https:\/\/www.rm-assessors.cat\/es\/hipoteca-multidivisa-es-pot-considerar-abusiva-i-reclamar-les-quantitats-pagades-en-exces\/","title":{"rendered":"Hipoteca multidivisa: Es pot considerar abusiva i reclamar les quantitats pagades en exc\u00e9s."},"content":{"rendered":"<p><strong>\u00a0<\/strong><\/p>\n<p>El Tribunal de Just\u00edcia de la Uni\u00f3 Europea i el Tribunal Suprem (en una sent\u00e8ncia dictada el passat 15\/11\/2017), s\u2019han posicionat respecte a la consideraci\u00f3 de la hipoteca multidivisa com a abusiva, per tractar-se d\u2019una condici\u00f3 general de la contractaci\u00f3 pr\u00e8viament redactada i imposada als prestataris i que en molts casos\u00a0 no va ser negociada, no superant per tant ni el control de transpar\u00e8ncia ni les exig\u00e8ncies de la Directiva 93\/13 sobre cl\u00e0usules abusives en contractes celebrats amb consumidors. <span style=\"color: #ff0000;\"><strong><span style=\"color: #000000;\">Destaquem<\/span>:<\/strong><\/span><\/p>\n<p><span style=\"color: #ff0000;\"><strong>Caracter\u00edstica de les hipoteques multidivisa: <\/strong><\/span>Malgrat ser contractades amb euros, les seves quotes d\u2019amortitzaci\u00f3 i capital es calculen en base al valor d\u2019una divisa diferent.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Fonament de la sent\u00e8ncia del Tribunal Suprem per considerar abusiva la hipoteca multidivisa<\/strong><\/span>; Els prestataris al subscriure el pr\u00e9stec desconeixien la transcend\u00e8ncia econ\u00f2mica que comportaria concertar una hipoteca en una altra moneda (en el cas de la sent\u00e8ncia, en yens), i tot i tenir la opci\u00f3 d&#8217;elegir a principis de mes la divisa en la que pagarien, les quotes resultants a pagar s&#8217;incrementaven considerablement, aix\u00ed com tamb\u00e9 augmentava cada mes el capital pendent d&#8217;amortitzar enlloc d&#8217;anar disminuint.<\/p>\n<p><strong><span style=\"color: #ff0000;\">Efectes de la sent\u00e8ncia:<\/span><\/strong> Els afectats per aquest tipus d\u2019hipoteques que hagin pagat de m\u00e9s per aplicaci\u00f3 d\u2019aquesta modalitat multidivisa del seu pr\u00e9stec hipotecari, poden reclamar les quantitats cobrades en exc\u00e9s<em><strong> encara que la hipoteca es trobi ja cancel\u00b7lada<\/strong><\/em>.<\/p>\n<figure id=\"attachment_2189\" aria-describedby=\"caption-attachment-2189\" style=\"width: 300px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2017\/06\/RM_Assessors_Foto_7.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"size-medium wp-image-2189\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2017\/06\/RM_Assessors_Foto_7-300x205.jpg\" alt=\"\" width=\"300\" height=\"205\" \/><\/a><figcaption id=\"caption-attachment-2189\" class=\"wp-caption-text\">Ansteigende Stapel mit M\u00fcnzen und einem Haus im Hintergrund<\/figcaption><\/figure>\n<p><em><strong><span style=\"color: #800080;\">Som advocats.
