Davant aquesta situaci\u00f3, el client t\u00e9 dues opcions:<\/p>\n<ul>\n<li>Contractar aquestes assegurances amb altres companyies per\u00f2 assumint llavors unes pitjors condicions en el pr\u00e9stec hipotecari.<\/li>\n<li>Acceptar la contractaci\u00f3 amb la companyia suggerida pel banc i negociar una reducci\u00f3 de les primes.<\/li>\n<\/ul>\n<p>El client es troba aix\u00ed en un atzucac: si vol rebre el pr\u00e9stec hipotecari ha d&#8217;acceptar l&#8217;asseguran\u00e7a de vida obligat\u00f2riament en la hipoteca, amb les condicions abusives imposades pel banc.<\/p>\n<p><span style=\"color: #ff0000;\"><strong>La Llei de reforma hipotec\u00e0ria, actualment en fase d&#8217;aprovaci\u00f3 parlament\u00e0ria inclou les seg\u00fcents novetats que pretenen posar fi a aquesta pr\u00e0ctica<\/strong><\/span>:<\/p>\n<ul>\n<li>Les entitats financeres hauran de presentar als seus clients ofertes alternatives -amb productes associats i sense- i permetre que, en el cas de les assegurances, el consumidor pugui contractar la p\u00f2lissa pel seu compte, complint els requisits establerts per l&#8217;entitat, i presentar-la al banc.<\/li>\n<li>\u00a0La norma no tindr\u00e0 car\u00e0cter retroactiu, per tant nom\u00e9s afectar\u00e0 a aquells que signin un pr\u00e9stec despr\u00e9s de la seva publicaci\u00f3 en el BOE. Les noves mesures no seran aplicables als contractes de pr\u00e9stec hipotecaris ja ven\u00e7uts, estiguin o no en fase de reclamaci\u00f3 judicial.<\/li>\n<li>Ser\u00e0 nul tot contracte vinculat al pr\u00e9stec que, en perjudici del prestatari, no compleixi amb les exig\u00e8ncies previstes. La nul\u00b7litat de les cl\u00e0usules del contracte de pr\u00e9stec que, si escau, afectin productes vinculats no determinar\u00e0 la nul\u00b7litat del pr\u00e9stec.<\/li>\n<li>L&#8217;acceptaci\u00f3 pel prestador d&#8217;una p\u00f2lissa alternativa, diferent de la proposada per part seva, no podr\u00e0 suposar empitjorament en les condicions de qualsevol naturalesa del pr\u00e9stec.<\/li>\n<\/ul>\n<p>No obstant no sabrem com acaba tot mentre la nova llei no sigui definitivament aprovada i publicada en el BOE.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/11\/shutterstock_686017330.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-2987\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2018\/11\/shutterstock_686017330.jpg\" alt=\"\" width=\"600\" height=\"600\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><em><strong><span style=\"color: #008000;\">Som corredors d&#8217;assegurances i us podem oferir les millors condicions del mercat.
