Aquesta disposici\u00f3 dona m\u00e9s facultats de control a l&#8217;INSS i a les m\u00fatues d&#8217;accidents de treball i en destaquem el seg\u00fcent:<\/p>\n<p><span style=\"text-decoration: underline;\"><strong><span style=\"color: #3366ff; text-decoration: underline;\">Comunicats de baixa<\/span><\/strong><\/span>:<\/p>\n<p>Els processos d\u2019incapacitat temporal es dividiran en funci\u00f3 de la seva durada estimada:<\/p>\n<ul>\n<li>Molt curta: Menys de 5 dies naturals.<\/li>\n<li>Curta:\u00a0 5 a 30 dies naturals.<\/li>\n<li>Mitjana:\u00a0 31 a 60 dies naturals.<\/li>\n<li>Llarga:\u00a0 61 dies naturals o m\u00e9s.<\/li>\n<\/ul>\n<p>Quan el metge estimi que la durada de la baixa ser\u00e0 molt curta, emetr\u00e0 en el mateix moment els comunicats de baixa i d\u2019alta. No obstant, el treballador podr\u00e0 exigir que se\u2019l revisi de nou en la data prevista per l\u2019alta i que, si cas, es rectifiqui la data de l\u2019alta.<\/p>\n<p>En els altres casos, el metge far\u00e0 constar en el comunicat la data en que haur\u00e0 d\u2019examinar de nou el treballador, que no podr\u00e0 excedir de 7 dies, o de 14 dies en cas que la durada que hagu\u00e9s previst per la baixa sigui llarga.<\/p>\n<p><a href=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_33653404.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-695\" src=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_33653404.jpg\" alt=\"laboral7\" width=\"658\" height=\"325\" srcset=\"https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_33653404.jpg 658w, https:\/\/www.rm-assessors.cat\/wp-content\/uploads\/2015\/02\/laboral7_33653404-300x148.jpg 300w\" sizes=\"(max-width: 658px) 100vw, 658px\" \/><\/a><\/p>\n<p><span style=\"text-decoration: underline;\"><strong><span style=\"color: #3366ff; text-decoration: underline;\">Comunicats de confirmaci\u00f3 de baixa:<\/span><\/strong><\/span><\/p>\n<p>Durant els proc\u00e9s de baixa, el metge haur\u00e0 de revisar el treballador i haur\u00e0 d\u2019emetre els comunicats de confirmaci\u00f3 de baixa en els seg\u00fcents terminis en funci\u00f3 de quina sigui la seva durada estimada:<\/p>\n<ul>\n<li>Curta: El primer als 7 dies de la baixa i els seg\u00fcents cada 14 dies com a m\u00e0xim.<\/li>\n<li>Mitjana: El primer als 7 dies de baixa i els seg\u00fcents cada 28 dies com a m\u00e0xim.<\/li>\n<li>Llarga: El primer als 14 dies i els seg\u00fcents cada 35 dies, com a m\u00e0xim.<\/li>\n<\/ul>\n<p>* En processos de llarga durada, quan el metge emeti el darrer comunicat anterior als 365 dies des de la data de la baixa avisar\u00e0 al treballador que a partir d\u2019aquell moment ser\u00e0 l\u2019Institut Nacional de la Seguretat Social (INSS) qui controlar\u00e0 el seu proc\u00e9s de baixa.<\/p>\n<p><strong><span style=\"text-decoration: underline;\"><span style=\"color: #3366ff; text-decoration: underline;\">Comunicats d\u2019alta:<\/span> <\/span><\/strong><\/p>\n<p>Deixant de banda la durada que s\u2019hagu\u00e9s previst de la baixa, el metge emetr\u00e0 el comunicat d\u2019alta en el moment en que consideri que el treballador ha recuperat la seva capacitat laboral.<\/p>\n<p>El metge tamb\u00e9 podr\u00e0 emetre el comunitat d\u2019alta quan el treballador no es presenti a revisi\u00f3 en la data prevista.<\/p>\n<p><strong><span style=\"text-decoration: underline;\"><span style=\"color: #3366ff; text-decoration: underline;\">Tramitaci\u00f3 dels comunicats. <span style=\"color: #ff0000; text-decoration: underline;\">Atenci\u00f3 empresaris !!<\/span><\/span><\/span><\/strong><span style=\"color: #ff0000;\">:<\/span><\/p>\n<p>* El metge entregar\u00e0 al treballador dues c\u00f2pies de cada comunicat, una per ell i una altra per l\u2019empresa.<\/p>\n<p>* El treballador haur\u00e0 d\u2019entregar la c\u00f2pia a l\u2019empresa en el termini de 3 dies la c\u00f2pia que li va destinada. Aquest termini ser\u00e0 de 24 hores en cas que el comunicat sigui d\u2019alta o simultani de baixa i alta en el cas de processos de data molt curta.<\/p>\n<p>* En els tres dies h\u00e0bils seg\u00fcents a la seva recepci\u00f3, l\u2019empresa haur\u00e0 de presentar a l\u2019INSS el comunicat rebut, fent-hi constar la base de cotitzaci\u00f3 i altres dades. La presentaci\u00f3 podr\u00e0 ser telem\u00e0tica per\u00f2 els comunicats en paper l&#8217;empresa els haur\u00e0 de conservar 4 anys.<\/p>\n<h3>\n<span style=\"color: #3366ff;\">Som assessors laborals.
